Artico is a digital platform for discovering, presenting and engaging with art, artists, galleries, exhibitions and related art services, with a particular focus on Myanmar art. Artico provides tools for artists to present their work, for galleries to present their programmes, and for collectors and art lovers to discover, follow and engage with art and its creators, including services related to artwork certification and provenance.

By accessing or using the Platform, you agree to these Terms and to Artico's Privacy Policy. If you do not agree with these Terms, please do not use the Platform. These Terms apply to all users of the Platform, including visitors, members, artists, galleries and collectors.

• You are responsible for providing accurate and complete account information, and for keeping it up to date.
• You are responsible for protecting your account credentials and for all activity performed through your account.
• You must notify Artico promptly if you believe your account has been accessed without authorization.

Artico may suspend or restrict accounts that violate these Terms or misuse the Platform, including where necessary to protect the integrity, security or reputation of the Platform or its users.

Artists are responsible for the accuracy and completeness of the information they submit about themselves and their artworks, including title, artist attribution, medium, dimensions, year, availability and price.

• Artists must have the necessary rights to upload and display the images and information they submit.
• Artists must not submit content that infringes the rights of any third party.

Artico may review, moderate, reject, hide or remove content that violates platform requirements or these Terms.

Approved galleries may create and manage gallery exhibitions and events, and submit related artwork information through the Platform.

• Galleries are responsible for the accuracy of the information and artist attribution they provide.
• Galleries must have the necessary rights or authorization to publish the material they submit.

Artico's approval of a Gallery account does not constitute an endorsement of every artwork, artist, event or representation made by that Gallery.

• MMK (Myanmar Kyat) is Artico's primary stored artwork price where pricing is provided.
• USD prices displayed by Artico may be automatically calculated using an exchange rate maintained by Artico for display purposes.
• Converted USD amounts are indicative display values and may differ from actual exchange rates or transaction values.
• Artico does not publicly disclose or guarantee any particular exchange rate.
• Artists and galleries remain responsible for their underlying listed prices where applicable.

• Artwork availability and pricing may change at any time.
• A listing does not guarantee that an artwork remains available until a transaction is confirmed.

Where Artico facilitates an inquiry, introduction or transaction, any applicable payment, delivery, commission or transaction terms will be presented as relevant to that transaction. Such terms apply only to the transaction to which they are presented.

Artico provides infrastructure for recording artist declarations, certificates and provenance records. An Artico Certificate of Authenticity & Provenance records information declared and recorded through the Artico system.

• Artico does not independently authenticate every artwork presented on the Platform.
• The appearance of an artwork on Artico, or the existence of an Artico certificate, is not itself a guarantee of authenticity.
• An artist declaration or record made through Artico is distinct from independent expert authentication of an artwork.

Users should exercise appropriate care and, where desired, seek independent expert advice before acquiring any artwork.

Where Artico's provenance system supports ownership transfers, those transfers may be recorded in the Artico Provenance Registry.

• Users participating in a transfer are responsible for providing accurate information.
• Users participating in a transfer must have the authority to transfer the relevant artwork.

A digital provenance record does not itself replace any legally required contract, payment, title document or other legal requirement applicable to a transaction.

Artists and other rights holders retain ownership of their artworks and the underlying intellectual property. Uploading content to Artico does not transfer copyright ownership to Artico.

• By granting Artico content for publication, users give Artico the necessary non-exclusive permission to display, reproduce and promote that content in connection with operating and promoting Artico and the relevant artist, artwork or exhibition.
• Users must not upload content they do not have the right to use.
• Artico's own branding, platform design, software, text and other proprietary materials remain protected by intellectual property law.

When using the Platform, you must not:

• Submit fraudulent, misleading or inaccurate information.
• Impersonate another person or misrepresent your identity or affiliation.
• Infringe the intellectual property or other rights of any person.
• Publish unlawful, harmful, abusive or otherwise objectionable content.
• Attempt to compromise the security, availability or integrity of the Platform.
• Misuse other users' information.
• Manipulate or attempt to manipulate provenance or certification records.
• Engage in any other activity that unreasonably interferes with the Platform or its users.

Artico offers services such as Collector Club and Gallery membership. The specific pricing, duration and benefits of each service are shown separately at the time of subscription or application. Membership benefits and availability may change as Artico develops its services. Where a membership is subject to additional terms, those terms apply to that membership in addition to these Terms.

Artico may review, restrict, suspend or remove accounts and content where reasonably necessary for platform integrity, legal compliance, security, or to address violations of these Terms. Where appropriate and reasonably practicable, Artico will notify affected users of such action.

The Platform may integrate with or link to third-party services. Those services are operated by third parties under their own terms and privacy practices, which may differ from these Terms and Artico's Privacy Policy. Artico is not responsible for third-party services, and your use of them is at your own risk and subject to their terms.

The Platform and related services are provided without guarantee of uninterrupted availability. In particular, Artico does not guarantee:

• The future value or marketability of any artwork.
• Any investment return from acquiring art.
• The accuracy of representations made by third parties.
• Independent authentication of every artwork presented on the Platform.

Artwork should not be presented or understood as a guaranteed investment. Decisions to acquire art are the user's own responsibility.

To the maximum extent permitted by applicable law, Artico shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profit, revenue, data or goodwill, arising out of or in connection with your use of the Platform. Artico's total aggregate liability arising out of or in connection with these Terms or the Platform shall not exceed the greater of (a) amounts you have paid to Artico in the twelve (12) months preceding the event giving rise to the claim, or (b) an amount permitted as a minimum under applicable law. Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited.

Artico may update or modify its services and these Terms from time to time. Material changes to these Terms will be reflected by updating the effective or last-updated date shown on this page and, where appropriate, by notifying users. Continued use of the Platform after a change to these Terms constitutes acceptance of the updated Terms.

The governing law and jurisdiction applicable to these Terms are being finalized by Artico and will be confirmed in a future update of these Terms. Until confirmed, nothing in these Terms limits any protection or right you have under the mandatory laws of your country of residence.
